Parties:
“We”; “Our” – refers to Teachers Pet On Line (Pty) Ltd (“Teachers Pet”),
“You”; “Your” – refers to you, the client of Teachers Pet.  
Terms:
“the Website” – refers to the online website used by Teachers Pet to display and sell their products

“the client” – refers to any person browsing or purchasing products on the Website. 

INTRODUCTION
Accessing any of the pages on the Website implies that you agree to the following Terms and Conditions (“Ts & Cs”) of the use of the Website. 

These Ts & Cs will apply to all orders concluded by or with Teachers Pet for the sale of any products from our Website and will be enforceable against every client.  

By making use of the Website, purchasing any products, providing any delivery instruction(s) or accepting delivery from Teachers Pet, you acknowledge that you have read these Ts & Cs and will constitute your unreserved acceptance of these Ts & Cs and your agreement to follow and be bound by them. 

It is important that users read these Ts & Cs together with our Privacy Policy

and clearly understand and agree to the terms therein.

Our services are provided to you subject to the following Ts and Cs:

PRODUCT INFORMATION
Selected products are advertised on the Website for clients to view and purchase.

While we make every effort to ensure that the product(s) you purchase correspond as closely as possible to the images seen on the Website, slight discrepancies may occur in colour.

The colours of our products shown on the Website may look different to the colours of the physical product received due to your device’s screen. This is because various screens display colours differently. Teachers

Pet will not be held responsible for any products which you have ordered whose colour is slightly different from that which it may appear on your device’s screen.

Teachers Pet may, at any time, in its sole discretion, and for whatever reason, without any prior notice to you, remove from or change any products on the Website.

IMPORTANT NOTICE
These Ts & Cs apply to clients who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (“the CPA”).

Your attention is drawn to these Ts & Cs as they are important to the client and should be carefully reviewed and noted.

Should you not understand any of the provisions in these Ts & Cs, then it is your responsibility to request an explanation from Teachers Pet and gain a clear understanding before accepting them.

Nothing found in these Ts & Cs is intended to unlawfully restrict, limit or avoid any right or obligation created for either Teachers Pet or you, in terms of the CPA.

PRICES & METHOD OF PAYMENT
We are always committed to providing secure online payment facilities to our Users. All transactions are encrypted using the appropriate encryption technology.

All prices displayed on the Website are quoted in South African Rands (ZAR) and include Value Added Taxation (VAT). All major debit cards and credit cards (MasterCard & Visa)

You warrant that you are fully authorised to use the payment method of your choice from the above-mentioned list.

You warrant that you have sufficient funds to cover all the costs incurred by you on the Website, and agree that you will be liable for the full payment of same to Teachers Pet.

Full payment of the purchase price and delivery charges are required before ordered products will be despatched for delivery to the client.

All products ordered will remain the property of Teachers Pet until payment is received in full.

The products and prices that are displayed on the Website may change, for whatever reason whatsoever, without any notification and are subject to availability.

DELIVERY
A delivery fee will be charged for all deliveries, the cost of which will be reflected at checkout and added to the purchase price, making up the total payment price due.

Full payment of the total payment price is required before ordered products will be despatched for delivery to the client.

Teacher’s Pet makes use of RAM Hand-to-Hand Couriers to deliver its products to its clients.

Standard Economy Road Freight delivery will be carried out on business days only.

Delivery time will vary depending on your chosen delivery address.

Cost of delivery will vary depending on your chosen delivery address.

It is your duty to ensure that the delivery address that you provide us with at checkout is correct.

Teachers Pet will not be liable for any products that have been delivered to the wrong address due to the incorrect address being provided by the client at checkout.

Please ensure that you inspect your product(s) upon delivery for any defects or damage before accepting them.

Upon acceptance of delivery, all risk in the product passes to the client.

RETURNS & REFUNDS
All clients have a period of 5 (five) days from date of delivery in which to return the products and receive a full refund from Teachers Pet (“the Return Period”).

If the Return Period has prescribed then clients will under no circumstances be eligible to return the products and receive a refund.

In order for a client to be eligible to receive a refund, the products must be returned to Teachers Pet in the exact same condition that they were delivered to the client.

Teachers Pet will only accept the return of products which have been delivered to the client with factory defects or which are delivered damaged (“faulty goods”). Clients are encouraged to document faulty goods and contact Teachers Pet immediately in order to process a return of those products.

Teachers Pet will not accept the return of any products that have been damaged by way of negligent use or misuse on behalf of the client.

Teachers Pet will not accept the return of products with general wear and tear.

Teachers Pet will not accept the return of custom orders.

Products that are exposed to direct sunlight for long periods of time may experience discolouring.

This is considered general wear and tear and cannot be returned.

In a case where a client has simply changed their mind about the products they have ordered and no longer want to keep them, Teachers Pet will only accept the return of products that are still in their

original packaging and have been returned within the Return Period. In such cases, Teachers Pet will not accept the return of products that have been opened.

Should a client wish to return a product, then the client will be liable for the cost of collection of said products.

CUSTOM ORDERS
Teachers Pet with only start manufacturing your custom order once payment is received in full.

As custom orders are made to order and not kept in stock, it will take longer to fulfil your order.

Fulfilment time will vary depending on your custom design provided and total size of order.

Teachers Pet will not accept the return of custom orders.

DISCOUNTS, PROMOTIONS & CODES
From time to time, Teachers Pet may offer discounts or promotions on its products.

All discounts and promotions will only be valid for a certain duration, as determined by Teachers Pet.

Teachers Pet may, at its sole discretion, provide/award clients with discount codes (“codes”) to be used on its products at checkout.

All discounts, promotions and codes used outside of their prescription period will be invalid and rejected.

ERRORS
When placing an order it is the client’s duty to make sure that all of their information provided is correct. Teachers Pet will not be held responsible for any incorrect orders that have been placed.

Teachers Pet makes every effort to ensure that all the information that we provide is correct, however, we cannot be responsible for any form of misprint.

Should any of the pricing of our products display any obvious and unreasonable errors, we will correct the error as soon as we have picked up on or have been notified of same.

Teachers Pet will not be bound by any obviously incorrect and unreasonable prices.

ELECTRONIC COMMUNICATION, COMMENTS & REVIEWS
Clients may post comments, reviews and other communications, submit suggestions and questions on Teachers Pet’s social media pages so long as the content is not defamatory, obscene, illegal, threatening, considered hate speech, invasive of privacy or otherwise injurious to third parties and does not consist of or contain commercial solicitation, chain letters, software viruses, mass mailings, political campaigning or any other form of “spam”. 

Teachers Pet reserves the right to edit or remove such content from any of its social media platforms. 

If you do submit material or post content on any of Teachers Pet’s social media pages, you grant Teachers Pet a nonexclusive, royalty-free, irrevocable, perpetual right to use, adapt, modify, publish, reproduce, translate, display and distribute the content in any media.

You also grant Teachers Pet the right to use the name that you submit in connection with the content.

You confirm that the content you post is accurate and does not violate policy and will not cause injury to any entity or person.

Teachers Pet has the right but no obligation to monitor and remove or edit content and activity.

Teachers Pet assumes no liability or responsibility for any content posted by clients or third parties.

Teachers Pet will not be held liable for any damage caused directly or indirectly by accessing and using the Website.

The Website or any portion of the Website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose.

You may not frame or utilise framing techniques to enclose any trademark, logo, or other proprietary information (including Images, text, page layout, or form) of Teachers Pet and our affiliates. 

You will not acquire any right, interest or title in or to the Website. Any use, reproduction, or distribution of the Website or the content therein is strictly prohibited.

INDEMNIFICATION
All clients make use of the Website entirely at their own risk and assume full responsibility for any and all risk or loss resulting from the use or inability to use the Website, or reliance on any information on the Website.

Teachers Pet and any of its representatives, agents, affiliates and partners will not be liable for any loss, damage or liability of any kind arising from the use or inability to use the Website or the services or content provided through or from the Website. 

Teachers Pet cannot and will not be held liable for any direct, indirect, incidental, special or
consequential damages or loss which may arise from your use or misuse of, or inability to use, or reliance upon the Website or the content therein.

You hereby indemnify Teachers Pet against any claim, damage or loss which may be suffered by you in any form from your use of the Website.

Teachers Pet respects your privacy and will take all reasonable measures to protect your Personal Information from third parties.

AMENDMENTS TO THESE TERMS & CONDITIONS
Teachers Pet may, at any time, in its sole discretion, amend any of the above Ts & Cs without any prior notice.

It is your responsibility to check them regularly and ensure that you are satisfied with the changes. In the event that you are not satisfied, you must not continue to make use of the Website or purchase any goods from Teachers Pet.

If any condition is deemed for any reason unenforceable, void or invalid, the condition will be deemed severable and will not affect the enforceability and validity of the remaining condition(s).

GENERAL
Teachers Pet may, at any time, in its sole discretion, and for whatever reason, without any prior notice to you, remove any products from the Website.

You may not cede, assign or otherwise transfer your rights and obligations in respect of these Ts & Cs to any third party.

Any failure on the part of Teachers Pet or you to enforce any right in respect hereof shall not constitute a waiver of that right.

If any condition found in these Ts & Cs is deemed, for any reason, unenforceable, void or invalid, the condition will be deemed severable and will not affect the enforceability and validity of the remaining condition(s). The remaining conditions will remain in full force.

No addition, variation, deletion, or agreed cancellation of these Ts & Cs will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.

No indulgence, relaxation or extension of time shown by either party hereto shall constitute a waiver of any rights.

These Ts & Cs contain the whole agreement between Teachers Pet and the client and no other undertaking or warranty is valid.

GOVERNING LAW & JURISDICTION
Unless any applicable law prescribes otherwise, these Ts & Cs shall be governed and interpreted in accordance with the laws of the Republic of South Africa.

By using the Website you consent to the jurisdiction of the South African courts regarding all legal proceedings instituted by either party against the other, arising from any of these Ts & Cs.
